These Terms and Conditions govern all purchases made through the website operated by The Viberstore Group Limited, trading as ViberStore. By placing an order on www.viberstore.ie, you agree to be bound by the terms outlined below. These terms do not affect your statutory rights as a consumer under Irish and EU law.

2. Eligibility to Purchase

To place an order through our website, you must be at least 18 years of age or have the permission of a parent or legal guardian. By submitting an order, you confirm that you are legally capable of entering into a binding contract and that the payment method used belongs to you or is authorised for your use.

We reserve the right to decline or cancel any order where we have reason to believe that the above criteria are not met, or where we suspect fraudulent activity or misuse of our platform. Additional identification may be requested for high-value purchases, and we reserve the right to verify payment details before dispatching any goods.

3. Products and Availability

ViberStore sells a range of new, second-hand, and refurbished devices, including but not limited to mobile phones and tablets. All products are subject to availability and may be withdrawn at any time without prior notice. We strive to ensure that product descriptions, specifications, and pricing are accurate; however, errors may occasionally occur. In the event of a pricing or description error, we reserve the right to correct the error and either cancel or revise your order.

In the event that a specific model, colour, or storage capacity is unavailable, a member of our team may contact you to offer an alternative. If the alternative is not acceptable to you, you will be entitled to a full refund.

All products sold by ViberStore are subject to standard VAT. VAT is included in the displayed price and a full VAT invoice will be provided with every order. Businesses and VAT-registered customers may reclaim VAT where applicable, in accordance with Irish tax regulations.

4. Pricing and Payment

All prices on our website are listed in Euro (EUR) and are inclusive of VAT where applicable. All products are sold under the standard VAT scheme and are eligible for VAT reclaim, where applicable. Pricing may vary based on market fluctuations and is subject to change without prior notice.

Full payment must be received and cleared before any goods are dispatched. We accept a range of secure payment methods including credit and debit cards. In certain cases, especially for high-value items, we may require photo identification and proof of address to verify the purchaser’s identity.

We reserve the right to cancel or refuse any order where pricing errors or unauthorised payment methods are identified.

5. Shipping and Delivery

We offer nationwide delivery within the Republic of Ireland. Same-day delivery is available within the Dublin area for orders placed before noon, Monday to Friday, excluding bank holidays. For orders outside of Dublin, we aim to deliver within 1–2 working days using trusted courier partners including DHL and UPS.

While we make every effort to meet these delivery timelines, delays may occasionally occur due to third-party logistics or peak seasonal volumes. We are not liable for delays beyond our control, but we will do our best to keep you informed of any issues.

All deliveries must be signed for by the person who placed the order. For security reasons, we do not deliver to third-party addresses such as neighbours or workplaces unless specifically arranged in advance. If no one is available to accept the delivery, the item may be returned to our warehouse and a redelivery charge may apply.

6. Returns and Cancellations

If you change your mind after purchasing online, you have the legal right to cancel your order within 14 days of receiving your goods, as per the Consumer Rights Act 2022. To exercise this right, you must notify us in writing (by email) within that 14-day period. You then have a further 14 days to return the goods.

ViberStore offers a 30-day return policy with free returns on all eligible products. This means that regardless of the reason — including change of mind — we will cover the cost of return shipping within Ireland if the return is initiated within 30 days of receiving your item. A prepaid return label will be issued once your return has been approved by our team.

Items must be returned in the same condition in which they were received: unused, undamaged, and in their original packaging with all accessories included. Returns that are incomplete, damaged, or show signs of use may be subject to a partial refund or rejection. to the original payment method within 3–5 working days of receiving and inspecting the returned goods. We will refund your standard delivery cost if the return is due to an error on our part, such as a faulty or incorrect item. All returns within 30 days qualify for a prepaid return label within Ireland and are free of charge, including change-of-mind returns.

To initiate a return, please contact returns@viberstore.com with your order number and reason for return. Our team will confirm eligibility and provide next steps.

7. Warranty

All devices sold by ViberStore come with a warranty of either 6 or 12 months, depending on the product type. The warranty covers manufacturing defects, software issues, and technical faults that are not the result of misuse or accidental damage. Batteries are covered for 90 days from the date of purchase.

The warranty does not cover:

  • Accidental or physical damage
  • Cracked screens, water damage, or cosmetic wear
  • Issues caused by third-party software or accessories
  • Repairs or modifications carried out by any party other than ViberStore

In the event of a valid warranty claim, we will repair or replace the device. Replacements may include refurbished parts or units. Warranty claims must be submitted with valid proof of purchase. Turnaround time for repairs is typically 48 hours from receipt of the item.

8. Competitions and Promotions

By entering a ViberStore competition, you agree to be bound by the terms of that competition and our general terms. Winners will be selected at random and announced via our official platforms. Once announced, winners have 30 days to claim their prize.

All prizes are non-transferable and cannot be exchanged for cash. ViberStore reserves the right to feature the winner’s name or image (with consent) on our platforms to promote transparency. Proof of identity may be required when claiming a prize.

Competitions may be cross-promoted across Facebook, Instagram, or other platforms, and entries may be pooled to ensure fairness. Any misuse or manipulation of the competition process will result in disqualification.

9. Limitation of Liability

Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under applicable law.

To the fullest extent permitted by law, ViberStore shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or products. Our total liability to you in any circumstance will be limited to the amount paid by you for the product in question.

We shall not be held liable for any failure or delay in our performance where such failure results from any cause beyond our reasonable control, including but not limited to natural disasters, strikes, delivery interruptions, or telecommunications failures.

10. Dispute Resolution and Governing Law

If you are unhappy with your purchase or the service you received, we encourage you to contact our team directly at returns@viberstore.com so we can resolve the issue promptly.

If a dispute arises and cannot be resolved through direct communication, you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. This service helps consumers and retailers settle disputes out of court.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

11. General Provisions

We may update these Terms and Conditions from time to time to reflect changes in our services or to comply with legal obligations. The latest version will always be available on our website. Continued use of our website indicates your acceptance of any updates.

No delay or failure by us in exercising any of our rights under these Terms and Conditions shall impair our rights or be construed as a waiver. If any part of these terms is deemed invalid or unenforceable, all other provisions shall remain in full force.

You may not transfer any of your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations without notice.
